ACP Publishing Pty Ltd v John Fairfax Publications Pty Ltd

The plaintiff sued on two imputations namely that ACP so poorly managed Woman’s Day magazine that its circulation fell by more than 200,000 copies over six months and that it was undesirable as an advertiser because of that slump. The first imputation was found to be conveyed by Whitlam J and no other defences were pleaded besides failure of the imputations to be conveyed although Fairfax did publish an apology which Whitlam J found only slightly mitigated the harm. … more
